On The Weight Of Electronic Evidence

The case about electronic evidence has already been in the civil actionof our country. As a piece of new thing, the electronic evidence questionhas already aroused some attention of the law field. Among the researchesof the electronic evidence, the study on weight of electronic evidenceis very important theory with a practical meaning. In view of this, thethesis has carried on a preliminary discussion on the weight of electronicevidence.The thesis is divided into four parts altogether except introductionand conclusion:Part one defines the weight of electronic evidence, involving itsdefinition, characteristics, makes an argument comparing weight ofelectronic evidence to the ability of electronic evidence; lastly,analyzes two influential factors that determine the weight of electronic evidence.Part two, briefly examines the judging system of the weight ofelectronic evidence in foreign countries and in international society;makes some investigations and studies on two typical cases to reflect thecurrent situation of the judging system of the weight of electronicevidence in our country;Part three, make suggestions for the reform and improvement on ourjudging system of the weight of electronic evidence by looking into thesystems of foreign countries and international society;Part four, based on the argumentation of two parts forward, gets anenlightenment to exalt at the weight of electronic evidence, and methodsof exaltation complies with the collection of the electronic evidence,storing of the electronic evidence and transforming of the electronicevidence.
