The Study On The Crossover Problem Of Administrative Litigation With Supplementary Civil Litigation

The crossover of civil disputes and administrative disputes has been increasing along with the enforcement of administrative litigation law, and it has become an urgent problem that needs to deal with properly. On the one hand, there are only some principles which are not operable, and leads to confusions in legal practice. On the other hand, the theory of administrative litigation with supplementary civil litigation brought up by some scholars still needs further study and discussion. The article argues that it is practical to build the administrative litigation with supplementary civil litigation system to settle the crossover problem of civil disputes and administrative disputes in currently situation. And the key is to put emphasis on the construction of administrative litigation with supplementary civil litigation system, and make it become the necessary supplement of current administrative litigation system. The article analyses several areas, such as the necessity, feasibility, principles of the system, as well as the scope of jurisdiction, and so on.
