Reestablishing The Spatial Layout Of Our Nation's Criminal Tribunal

The spatial layout of a tribunal manifests the structure of a court trial most directly and the key factor is the seat arrangement for different members of the lawsuit. Different arrangements reflect different judicial and litigious ideas, which is quite the same with the criminal lawsuit with its particular pattern and procedure of a court trial. However, the present layout of a criminal tribunal can neither entirely show the positions or the mutual relations of the prosecuting party, the advocates and the adjudicatory personnel, nor the judicial idea of the modern criminal lawsuit and moreover, it is no longer suitable for the technical requirements of the regular trial after the trial's mode has been reformed.The thesis has researched and positioned the structure of our nation's criminal tribunal. In a special perspective that the proper technical arrangement of a tribunal's spatial layout can reveal a court trial's structure, the thesis talks about the disadvantages of the present criminal tribunal's layout and proposes a daring and radical plan of reestablishing the criminal tribunal's layout in order that the tribunal could get rid of the above-mentioned disadvantages and realize the goal of a criminal lawsuit, which is to punish the criminal and to protect the human rights. Besides, the author hopes to promote another increasingly urgent amendment of our nation's Criminal Proceeding Law.
