| Legislation of American special education has been established much earlier. So far it has formed a system of relative maturity, by which it can lead the trend of legislation in the field of special education. On the other hand, legislation in the field of Chinese special education has got its start rather late, and the system construction is relative lagged; however, the legislation of Chinese special education, as a whole, still has formed a set of system with Chinese characteristics. This essay aims to analyze the causes, basic principles, development and effects of IDEA in America; moreover, it analyzes the impact that American special education has extended on Chinese special education. Also we can make some comparisons between these two legislation systems and find the constructive elements of the American special education legislation and use them for conference in the process of Chinese special education legislation, and expect to improve the perfection of the legislation system in the field of Chinese special education. This paper is totally divided into four parts, its basic frame and main contents as follows:The first part has raised the issue, and given out the meaning, methods and aims of the study.The second part has recalled the origins and fundamental rules of IDEA in America, and has introduced its development process and effects.The third part has introduced the development process at every stage of the laws, regulations and policies of special education and has introduced the features of special education legislation in our country.The fourth part, in view of the present situations of special education in our country, has discussed the problems of special education legislation and analyzed its causes.The last part has presented that our country must lead the thoughts of modern special education into the special education legislation, and gave feasible suggestions about how to perfect special education legislation.
