Education equality is the key problem of educational field at home and abroad, the research of the equality is the sign of social civilization's advance, which has embodied the world-wide concerning for the weak tendency group that gets educational right. This paper aims at exploring the development and advance of special education in our country under this global education tide, and the development of special education in learning from foreign legislative experience, and the relationship between our special and foreign education legislation, then discusses the special education legislation to protect persons with disabilities on getting the equal right to education for children with special needs and achieve. This paper can be divided into 5 parts:The first part has introduced the development of the special education of our country, reviewed and commented the history of special education, as well as the achievements of our country since its building, and given some comments on injustice and the plight of the special education sector from the vision outlined in the current education equality, noting that legislation is imperative to develop and improve special education.The second part has recalled the lessons of our special education legislation and the development process at every stage of the promulgation of laws, regulations and policies of the sort, summed up the legislative characteristics, analysed and explored the problems.The part of 3th has demonstrated the equally-educated problem of the special educational child in the special educational legislation of our country, discussed the cause of educational fair realization emphatically and reached conclusion finally.The part of 4th has introduced in detail the foreign special education legislation's historical process and legislative characteristic such as the United States and Britain, summarized the advanced experience in order to bring certain reference for the special education of our country.The part of 5th has given some advice for the development and perfection of our special education legislation and made recommendations for the future development trend.
