This paper consists of five parts, including preface, general discussion on biological genetic resources, analysis on systems of biological genetic resources protection in developing countries, analysis and construction on systems of biological genetic resources protection in China and conclusion. In the part of preface, the paper brings forward the challenges faced by developing countries in protecting genetic resources, and introduces the paper's background; after that, the paper defines concept and extension of biological genetic resources, and lists the characteristics of biological genetic resources, which provides discussion environment for this paper; and then, the paper chooses several typical developing countries with abundant genetic resources, including India, Brazil and South Africa, and discusses the necessary, actuality and problems on biological genetic resources protection in these countries, especially introduces the legislation and systems of biological genetic resources protection and analyzes their obstacles in several aspects. As the main body of the paper, the second and third parts give the detailed discussion from the aspects of theory and practice, international law and domestic law of the developing countries. Among these discussion and analysis, the paper puts forward the imagination on constructing systems of biological genetic resources protection with Chinese characteristics by learning from other countries. The fourth part of this paper selected China who is the most typical developing country in the world, it introduces the actuality and features of biological genetic resources in China, and analyzes the necessary of constructing new systems of biological genetic resources protection; the fourth part also finds problems from the existing systems of biological genetic resources protection in China and provides corresponding solutions and advices, including the principles, systems, management mechanism and etc., especially emphasizes benefit–sharing from biological genetic resources and protection of intellectual property rights. In the part of conclusion, the paper points out that the advices and theories should be improved in the future and have a long way to go.
