Intellectual property protection of biological genetic resources is currently a hot topic, developed and developing countries in the commercialization of genetic resources, benefit-sharing after use when conflicts arise due to economic interests more prominent, controversial. The United States, the European Union as the representative of the other modern biotechnology developed countries, strong demand and reasonable development of the global share of biological genetic resources and intellectual property system, according to maturity to protect its innovative intellectual work, to developing countries create a greater entry barriers and thresholds. While Brazil, India, rich in genetic resources are now less advanced biotech countries, developed countries are resisting this demand, and to fight for the developed countries on the commercialization of genetic resources, use of results of benefit-sharing.Biological genetic resources in China is relatively rich in power, but also modern biotechnology developed countries. Although China's current environmental and resource protection laws and regulations and intellectual property laws and regulations than more, but these management system is a bit confusing, do not form an organic whole, management efforts can not fully in place, some areas still vacant. Overall, our genetic resources in the biological model of intellectual property protection is relatively backward, the biological genetic resources, intellectual property protection system has not established the need to place more with international standards. Intellectual property protection of genetic resources, biological model approach can be used more generally franchise model, model of new plant variety rights, trade secret form of trademarks and geographical indications and so on. In this paper, the feasibility of these methods and their difficulties and restrictive analyzed and presented according to China's national conditions and characteristics of their initial proposal.
