The Establishment Of Hearing Procedure In The System Of Levying Rural Land

The system of levying rural land is a very important system in manegement of land, which there are special stipulatations to it in our country's law of constitution and law of manegement of land . Because the premise of levying rural land must to be for public value are very vague and the level of compensation for it are very low, in addition, there are many phenomenon of error procedure ,the legal rights which belong to the side who is levied are often encroached.The author suggest a way of using hearing in process of land's levying in order to strengthen the side who is levied. The article is composed of the following four parts :In first chapter, there are normal introduction to the base theories of levying behavior, its conceptions, characters, principles, and its theory foundations; In second , according to the clues of our country's law and social changement, the author introduce the procedure and development history in turn about the system of levying rural land, and point out the harmness and question lied in present system by analyzing the premise of public value, the level of compensation ,and its procedure. In third, the author analyse the necessity and feasibility of hearing procedure in levying system .The last chapter is the core of this article, the author design the specific application of the hearing in levying system based on the three priciple which have mentioned.
