A Disquisition On Perfect The Juvenile Judiciary System

In order to protect the growth of juvenile healthy, prevent and reduced crime effectively, we must as soon as constitute the juvenile judiciary system. The juvenile judiciary system is a special judiciary system of Country Judicial Department and the judiciary organization dealing with the lawsuit and the non-lawsuit case of juvenile, protecting and educating the young person growth healthy, and is a total work routine of these departments and organization's nature,the duty,the organization system and the active principle . The juvenile judiciary system may be understood from three aspects of generalized,middle,and narrow, its development manifests the tendency from the narrow juvenile judiciary to generalized. It is because that youth's general psychology,physiological characteristic are different with the adult, the reason and the characteristic of the juvenile crime have its particularity compared with the adult, so, the juvenile judiciary system should carry out the principle of education and protection in judicial idea and judicial process throughout, but not adopt the legal penalty method purely. Embarked from the rationale of the juvenile judiciary system, and profited from the beneficial foreign juvenile judicature idea and the practice, the author tries to get some ponderations integrating the present situation of the juvenile judiciary system in our country. The author emphatically want to put forward certain proposals about how to establish the juvenile judiciary system complete, and tries to establish the suits of minor's criminal handling measure and the non-penalty processing method.
