On The Perfection Of Juvenile Delinquency Penalty System In China

With the rapid development of economy and progress in contemporary China,our comprehensive national strength is growing and international status is rising whilegenerating a lot of social problems and contradictions. As a social problem, minorcrimes are becoming increasingly serious and can not be ignored by the internationalcommunity. How to effectively prevent and curb juvenile crimes has become theworld-wide discussion in the international community. In China, concerning on theissue of minor crimes, we adhere to the policy of education, persuasion andredemption and insist the principle of “education first, penalty second”, to reflect thejudicial idea of giving priority to protectionism and giving consideration toresponsibility. Although some progress has been made in the study of JuvenileDelinquency Penology in China, compared to the Advanced Level in internationalcommunities, our study still has many deficiencies because of starting late. In China,the penal system for Juvenile Delinquency applies mainly to sentences imprisonment,and more regulations are simple and rough, which against the purpose of punishmentand the spirit of legislation for minors crime and bad to the physical and mentaldevelopment of minors.In this dissertation, some basic concepts and the definition of penal system forJuvenile Delinquency are discussed. And then the present situations of penal systemfor minor crimes are analyzed. As for the problems and shortcomings of penal systemfor minor crimes, In order to improve the penal system for Juvenile Delinquency,some advices are proposed according to conditions of China including theimprovement of penalty discretion system, improvement of penalty execution systemand so on.
