The Study Of Legal Protection Of Mental Patients

Accounts for most mental patients living around us were incapable to identify, understand or judge as normal people did, and they could not correctly understand their behaviors, in addition to many people despised those mental patients, therefore the living conditions of them were very worrying. As civilized society, those mental patients should receive attention and protection. What's more, the legal protection for mental patients was of special importance.The lightness of legal protection for mental patients could be proven from the aspects of utility and morality and equal human rights, for utility: to protect mental patient could promote the benefit maximization of mental patient, the same as that of social benefit. For morality: Mental patients should enjoy his natural basic rights as human being himself. For equal human rights: the rights of mental patient were natured to him instead of charity. This paper studied from legislation principle of mental patient protection, further to clarify the responsibilities from society, states, medical treatment bodies and family members. Finally it discussed the strengthening of two important systems of compulsory medical treatment and medical nursing service, and proposed to conduct complete reforming of compulsory medical system; brought forward corresponding suggestions regarding to the establishment and responaibilities of medical nursing personnel. Besides it pointed out that the mental hygiene legislation should regard the respect, protection and human rights fulfillment of mental patients as the most essential value.
