On The Issue Of The Professional Civil Liability

In a more complicated modern society, people need more service with special knowledge and have more chances to contact professionals. There is the imbalance between the professionals who hold special knowledge in a specific field and the common people who hold legal relationship with them. Then the professional's obligation is brought to the table. The professional liability issue has been attached great importance by the legislature , judicial and scholars in recent years. In China, this legal proposition has become to draw people's attention, but the theoretical inquiry into it is now in a initial stage ,and the framework of legislation is not perfect, which is also the original intention of this thesis.The thesis mainly uses methods of law interpretation, comparison, case analysis and so on. The highlight is the systemic study of the professional civil liability and the relative suggestion.This thesis has been divided into four chapters.The first chapter gives a summary of professional liability, including the scope and feature of professional, the connotation of the professional liability.The second chapter probes into the cognizance of professional liability, discusses the professional liability of fault, and analyses the composing facts from harmful result, wrongful deed, causality and fault.The third chapter introduces professional liability in the two main legal systems respectively with the examples of several typical countries while comparing their difference.The fourth chapter recommends the current legislation and jurisdiction of professional liability in China, and puts forward some proposals to perfect legislation and jurisdiction of professional liability.
