At present, Chinese theoretical research about the responsibility of thearchitects is falling behind many countries. With the participation in building engineeringis complex and complicated, the architects are often hidden in a multitude of liabilitysubject,so it is hard to investigated the responsibilities of architects experts in thejudicial practice.These have seriously hampered the whole building design industry andthe development of China’s economy. Fully and strictly regulating the liability ofarchitects is what current law should focus on. Therefore,strengthening the theoryresearch and legislation of architect expert liability,,establishing and improving theresponsibility system of architect experts,which are of great theoretical significance andpractical significance.The paper is divided into four parts to research the responsibility of the architects.The first chapter describes the meaning, definition and legal basis of the architectsProfessional Liability. The second chapter discusses about the cognizance of architectsProfessional Liability. At the first part,it researches the criterion of responsibility of thearchitects Professional Liability, pointing out that it should belong to fault liabilityprinciple. Then I analysis the architects Professional Liability in China from two aspects:contracted liability and tortious liability. The third chapter discusses thebehavioral subjects, main responsibility and the scope of damage compensation of thearchitects Professional Liability. The fourth chapter summarizes the legislative status quoand defects of the architects Professional Liability,and presents legislative proposals toimprove architects Professional Liability in China.
