The Twenty-first century is the century of ocean. With the further development and use of the ocean resource, human will depend upon ocean more and more, while the protection of ocean is overlooked. Among all the ocean pollutions, the most destructive is the oil pollution damage, the problem that how to guarantee full compensation for victim and ensure the steady development of shipping industry is paid more and more attention. Because of the fact that compulsory liability insurance plays a very criminal role in compensation for oil pollution damage, this thesis is to make a thorough study on the relevant concepts, legislations, rules and theories in order to offer references to our country's legislation. legislation. This thesis consists of three chapters. Chapter 1 makes a brief introduction about the compulsory liability insurance, then makes a thorough comparison with normal liability insurance and social insurance, and lastly draws a conclusion that compulsory liability insurance plays the same role as the social insurance, while operates in the business model.Chapter 2 With the international conventions and some countries' legislation of this system, this chapter analyzes the current situation of legislation of liability in our countryChapter 3 makes an analysis about the current situation and development trend of shipping industry and liability insurance, and concludes that it is imperative to set up the system of compulsory liability insurance and to remedy the blank of this legislation.Chapter 4 analyzes the basic theories of the system of compulsory liability insurance, including insurer, insured, the third parties' right of direct action, and relation between compulsory liability and direct action.
