Study On Execution Of Ecnomic Autonomy By Autonomous Institution In Ethnic Autonomous Region

On Feb. 28, 2001 the Law of Ethnic Regional Autonomy was amended under the new situation of Western Development Program, it absorbed many favorable policies of the state council about Western Development Program. Most conditions and terms of the amended Law of Ethnic Regional Autonomy obey certain principles. According to our country's real situation, the reformation and opening is processing, many policies and measures have not been finally determined. We need to work hard on how to deal with the favorable policies and aidant policies of Law of Ethnic Regional Autonomy and on how to join the favorable economic policies with the economic autonomy that regulated in law. Meanwhile, because of some existed problems the execution of ethnic autonomous regions' autonomy and some interrelated factors that influence the power of autonomy laws should be studied to vindicate the authority of Law of Ethnic Regional Autonomy and the warrant of autonomy. The seriousness of law lies on the security and execution. Because of different reasons, our country's rules of law or detailed laws on how to execute that match with Autonomy are not perfect, the security measures of self-government institutions are not perfect enough, and the responsibilities are carried out improperly, which objectively restricts the execution of Law of Ethnic Regional Autonomy to some degree. Hence the study of economic autonomy in autonomous regions can promote the execution of new Law of Ethnic Regional Autonomy and the socialism legal construction in ethnic autonomous districts from the law standpoint.At present the reasons that ethnic autonomous regions' economic autonomy could not be effectively executed are: One is that higher state institutions don't put enough emphasize on exertion of economic autonomy. The second is that some institutions in autonomous regions don't understand the economic autonomy. When some autonomous region departments set down autonomous laws they just copy the rules in Constitution and Law of Ethnic Regional Autonomy, which could not fit ethnic region characteristics. And the conditions and terms that don't fit ethnic regions have not been changed. The content of local autonomous laws is of poor quality; The third is that our security system of law is not sound.This paper mainly discusses the execution of economic autonomy in ethnic autonomous regions. The final step of a law or a policy is to perform and execute it, without execution even good law or policy can not function at all. There are exact rules about national economic autonomy in Constitution and Law of Ethnic Regional Autonomy, but the economic autonomy didn't attract enough attention, the national laws are not sound, the competition rule of market economy collides with the execution of economic autonomy, there are gaps between eastern and western regions, so some new tasks are proposed on how to embody the economic autonomy in ethnic autonomous regions in aspects of using of resource and distribution of benefits.This paper tries to discuss the way to consummate our country's economic legislative right, to execute ethnic autonomous departments' economic autonomy, to consummate the supervise system of ethnic economic autonomy, to consummate finance transfer payment system and the autonomy of natural resources in ethnic autonomous regions. And some measures on how to consummate economic autonomy in ethnic autonomous regions are proposed in this paper.
