National Enforcement Of Administrative Law In The Field Of Vision Of Rule Of Law

Enforcement of Administrative Law is a very important part of our national administration. Its function is indispensable on that the country carries out its organizational administration on society for legal and steady social order. But a series of puzzles on law and society are too impatient to wait for resolving while its implementing. As one kind of expression of Public Power, it must be cleared and carded originally and theoretically under the field of vision of Rule of Law. Only doing so can supply correct theoretical coordinate for Chinese reform-practice on enforcement of Administrative Law, and find the theoretical access to resolving those puzzles in essence.There are six sections for my topic in this paper: the first part "introduction" is to explain research object, research coordinate, territory, meaning and etc.Part two is to remark national power and government power theoretically in all-round. There are two layers: First it is the layer of value. From the logical premise of Rule of Law, the paper narrate the national power's happening and value judgment under the field of vision of Rule of Law in theoretical and logical sequence with "the sin of human nature" to "essential sin". On the basis of this the paper opens up the layer of reality (practice) that in what pattern national power lives and in what way government power fulfils in theory. The third part is to explain the action and position of enforcement of Administrative Law in national administration, and the relationship between them. These contents begin with two main aspects of "enforcement of Administrative Law and national (public) administration" and "enforcement of Administrative Law and Law implementation".Part four is to illustrate the theoretical basis and legal background of Chinese administration and enforcement of Administrative Law involving investigation, analysis, problem carding, concluding and reflecting in the light of the real status of Chinese enforcement of Administrative Law.Part five provides with solutions for outstanding problems in the course of enforcement of Administrative Law (whole national administration) in China. There are whole destination and plan, and concrete ideas too, from theory to reality.The last section emphasizes: it is rational and can be successful that our country's construction on enforcement of Administrative Law goes in for the way of "Rule of Law" step by step on the basis of social reality.
