The Research On Reform Mechanism In Chinese Prisons

The public often pay high attention to the rate of recidivism, so depressing the rate of recidivism by reform and rehabilitation is usually thought as Prison Institution's goal and duty to society, though the reasons of recidivism is very complicate. In recent years, we have to face the reality the rate of recidivism is sharply raising, and all Crime Institutions should analyze the reasons to found ways to settle it. In the time I work in prison administrative department, I feel the reform ability of Prison Institution is very poor. The contemporary reality of prison system is obviously low level of ensuring funds, non-scientific prison distribution, the restricting of state crime legislative system and the absence of scientific reform theories and methods. Those phenomena suggest that the scientific reform work need the guidance of theoretic research achievements. Through the evaluation of the present reform work, the article put forward four aspects of opinions to resolve the difficulties existing in current prison system.Firstly, the law about reform should be improved; Secondly, the state's outer ensuring function to prisons should be made better. The author suggests the prisons in our country should regulate its distribution and gives three principles to do it. It is necessary to build a new efficient prison reform system in which the prison enterprises keep apart from prisons itself and the prison's income keep apart from it's outcome ,so the function of prisons can be pure . Thirdly, the prison itself should improve it's reform theories and methods . The model of the scientific reform should be built up. From the moment when criminals enter the prison to the finish punishment, the rehabilitation and return to the society should be our utmost purpose. Generally speaking, criminals should be divided into different categories and executed in different prison systems. Furthermore, we can change the restraints on the release on probation and improve the rate of its application. We can also create and widen new education methods for reform and build progressive treatment policy so that the tenet of the prison system can be realized. The author thinks it is very important to improve the criminal's psychology cure and evaluation of reform quality. It is necessary to advance the prison police's professionalization. Certainly, in reform work the criminal's human right should be well protected. Finally, the author suggests we should advance the socialization of execution of sentence and improve the optimistic treatment to adapt the international current of execution of sentence.
