The Application Of The Criminal Policy Of Tempering Justice With Mercy In Punishing The Commercial Bribery

The CCP,in 2004,proposed the aim of building up a harmonious socety in our socialist country and also regard it as the theme of the time. With the guidance of thisthought,the CCP proposed the criminal policy of tempering justice with mercy.Therefore,the criminal policy of tempering with mercy is a program and alsoa criminal policty based on the rule of criminal law.Ithas a guiding significance from the point of macro-criminal development or from the point of micro-specific practice.It is appropriate in the development of society both scientifically and strategically.After opening-up,our country has got access to the market economy.The fast development of ec economy accelerates the confrontations of multi-parties,and there appear lots of commercial briberies and also to the extent of seriousness.The General Party Secretary,Mr Hu Jingtao,pointed out in 2005"It is a basic requirement to maintian the market order by strongly punishing the commercial briberies and it iw also an important content in anti-corruption".The CCP also signed special task to punish the commercial bribery.The article analyzes from the above two background the practice of the law related to the commercial bribery available.It also discusses the following issues such as:based on the tempering justice with mercy,adds and improves the regulations of the commercial bribery,renew the structure of the related punishment,strongly punish the serious commercial bribery which had wide and serious spread with great influence,make good use of the pokicy of tempering justice with mercy to deal with those not so serious ones to divide and demorlize the criminals.We believethat through the discussion of the above issues,it has dignificant meanings to strengthen the punishment of the commercial bribery by using the policy of tempering justice with mercy and have better understanding of the policy.
