On The Application Of The Criminal Policy Of Tempering Justice With Strictness In The Law Enforcement Work Of Prisons

Theory of tempering justice with mercy,has a long history in the history of Chinese legal system,and it is the essence of chinese traditional legal culture.Tempering criminal policy is the basic criminal policy in China.The implementation of the policy has very important meaning to prevent and reduce crime,resolving social contradictions and promoting social harmony and stability.As the country's main punishment executive organ,prison bearing the special functions to punish and reform criminals,preventing and reducing crime.On implementation of criminal policy of tempering justice with mercy is very important to educate and remold the criminals,and to promote social harmony and stability.Firstly,this paper makes a brief overview and analysis of the history of the criminal policy of tempering justice with mercy,and its forming process and connotation.Secondly,it makes a specific analysis how the policy of tempering justice with mercy apply to the implementation of prison sentence.(classified management of criminals,the scores management,commutation and parole).Thirdly,this paper points out the implementation of prison sentence in contrary to the policy of tempering justice with mercy,and how to solute it.Lastly,it puts forward some suggestions on prison execute penalty work,in order to improve the theory of tempering justice with mercy.
