A Study On The System Of The People's Supervisor

In August, 2003, Supreme People's Procuratorate, in order to solve the outside supervision question of the duty crime, protect judicature fair, established the people's supervisor system. Specifically, selecting supervisors from the people, investigate and deal with the duty crime cases, for"three kind of cases"(refusing to accept the arrest, preparing not sue, planning to abolish) and"five kind of situations". It conforming to the development of international judicial civilization, manifesting the request of lawsuit democratization, was our country's innovation in examination organizational reform. After several years of experiment, while obtaining the good results, it also has some imperfect aspect. So, we conduct this research and discussion from theory to the people's supervisor system, and this has the positive sense of reality.This article, firstly elaborated people's supervisor system's background as well as the basic connotation, and explore the people's supervisor system rationale. And through comparing the overseas relational system, the American grand jury pattern and the Japanese examining committee system, it gave our some enlightenments. In this foundation, with the rational thought, analyzed the achievement and implementation situation of the people's supervisor system. Finally, author induced the principle of our country's people supervisor system, and proposed strengthening law idea putting certain proposals of the consummation for concrete system.
