Research On The System Of People's Supervisor

The system of people's supervisor is an important reform measure in the examination organizational reform,which the Supreme People's Procuratorate promotes for the implementation party's 16 big spirits,it is also an important exploration to advance the judicature organizational reform.The people's supervisor system is advantageous to the strengthening procuratorial agency's outside supervision, it is advantageous to promot the procuratorial agency's law enforcement thought, the law enforcement idea and the law enforcement attitude for transformation, it is also advantageous to defend litigant's legitimate rights and interests well, thus mainten the Country Law Surveillance Institution's good image. The people's supervisor system took in the examination organizational reform as a newborn system, it has obtained certain positive effect in reality, but it similarly also has certain problem.From the theory and the practice angle,this article embarks the people's supervisor system basic concept, the rationale as well as its existence related question and the correlation consummation measure which has carried on the elaboration. I hope this can promote the system for further consummation and the development by the time. This article is divided into four parts, the first part is the overview about the system of people'supervisor, mainly discussed from three aspects,including the system's meaning, nature and its background The second part of this article is about the theoretical basis of the system, mainly discussed from the foundation of Law, sociology and political,these can play an important role on the system'rationality and legitimacy. The fourth area is about how to reform and perfect the system,mainly discussed form the principle of the system, the path and the relevant safeguards in detail,which will be able to promot and improve the system of people' supervisor, giving full play to its function and role.
