A Study On The System Of Administrative Law Enforcement Responsibility

Right without relief is false right while power with no responsibility is lawless power." Enforcing administrative law enforcement responsibility is an important way to enforce administration according to law and establish responsible government because China is under a changing epoch. The author tries to study this topic in order to study administrative law enforcement responsibility deeply and enhance administration according to law.Because of the importance of administrative law enforcement responsibility and the lack of its study, this thesis methodically studies the concept and theoretical basis of administrative law enforcement responsibility, meanwhile, it analyzes some serious problems of theory and practice in administrative law enforcement responsibility. Several suggestions are further given in order to perfect the system of administrative law enforcement responsibility. This thesis is composed of introduction, text and conclusion. The introduction briefly introduces the background of writing this thesis. The text is divided into five chapters. The chapter 1 is about the summary of administrative law enforcement responsibility. In this chapter administrative law enforcement responsibility is deeply analyzed and specifically expounded. The chapter 2 is about the theoretical basis of administrative law enforcement responsibility. This chapter includes the basis of Jurisprudence, the basis of Constitutional Law, the basis of Administrative law and the basis of Politics. It theoretically proves the proper and the ration of administrative law enforcement responsibility. The chapter 3 is about learning from other countries on administrative law enforcement responsibility. In this chapter, the author introduces the supervision and the control of administrative power, meanwhile, she expounds the advanced action of responsibility with violating administrative law in other countries. The chapter 4 is about the condition of administrative law enforcement responsibility in our country. This part mainly argues the defection of administrative law enforcement responsibility in the process of legislation and enforcement, at the same time, it analyzes the reason of the defection. The chapter 5 is about the perfection of the system of administrative law enforcement responsibility. In this chapter, the author studies administrative law enforcement responsibility on legislation and enforcement and gives some suggestions on perfecting administrative law enforcement responsibility. At last, in the conclusion part, the thesis points out clearly we should govern by law to administrative law enforcement responsibility and pay attention to it. In a word, on the basis of original study, this thesis can come to a revised definition of administrative law enforcement responsibility and can study further systematically, thus we can standardize the behavior of administrative law enforcement to make it enough bear the historical responsibility of promoting economic development and social progress.
