Study On The Problems And Countermeasures Of Administrative Law Enforcement In Xiangxi Prefecture

Since the 18 th National Congress of the Communist Party of China,the Party Central Committee has put forward a series of new ideas,new strategies and new ideas for the comprehensive rule of law.On the one hand,it is necessary to adhere to the rule of law,rule of law,and promote the administration according to law,and build a country under the rule of law,a government under the rule of law,and a society under the rule of law.We can see the importance of ruling by law and administration by law in the overall plan of ruling the country by law.In order to realize the rule of law and administration according to law,we must standardize the work of administrative law enforcement from the basis of law enforcement,the main body of law enforcement and the ring of law enforcement.Only when the administrative law enforcement is constantly standardized and perfected,can its function of implementing law,realizing the function of government management and safeguarding the rights of citizens be effectively realized.At present,China's administrative law enforcement is facing many difficulties,such as the administrative laws and regulations are too scattered and jumbled,the jurisdiction of administrative law enforcement subjects is easy to cross and overlap,the citizens know the law,abide by the law,and the sense of usage is not strong.However,these dilemmas often lead to a series of law enforcement problems,which are especially obvious in the administrative law enforcement work of grass-roots areas,especially in some remote areas such as Xiangxi Tujia and Miao Autonomous Prefecture of Hunan Province(hereinafter referred to as Xiangxi Prefecture).There are many problems in the process of administrative law enforcement in Xiangxi Prefecture because the relevant elements involved in administrative law enforcement are not perfect.For example,some areas of public management are unable to effectively carry out administrative law enforcement due to the lack of law enforcement basis,the low comprehensive quality of law enforcement personnel leads to low level of law enforcement and arbitrary law enforcement,human situation law enforcement,and the lack of legal awareness of the public leads to the repeated prohibition of some illegal events and so on.Therefore,the research on administrative law enforcement and Countermeasures in Xiangxi Prefecture has become an indispensable topic in the process of governing Xiangxi Prefecture by law.It is of great practical and theoretical significance to study it systematically.This paper first defines the administrative law enforcement,including the concept,functional characteristics and elements ofadministrative law enforcement(i.e.law enforcement basis,law enforcement subject and law enforcement environment),and discusses the elements of administrative law enforcement in Xiangxi Prefecture;secondly,it points out the current administrative law enforcement in Xiangxi Prefecture by visiting some administrative law enforcement agencies in Xiangxi Prefecture,sampling administrative litigation cases in Xiangxi Prefecture and analyzing social phenomena The specific problems existing in the law;then from the elements of administrative law enforcement in Xiangxi Prefecture,the causes of the problems are analyzed as follows: the lack of law enforcement basis itself and its establishment mechanism,the restriction of the responsibility and authority of law enforcement agencies,the low comprehensive quality of law enforcement personnel,the weak legal awareness of citizens,etc.;finally,some suggestions are put forward to optimize the administrative law enforcement in Xiangxi Prefecture,including improving the law enforcement basis and the main body of law enforcement,optimize the law enforcement environment,etc.,in order to further improve the efficiency of administrative law enforcement and better protect the basic rights of citizens.
