Research On Emergency Safeguard Measures In GATS

Emergency Safeguard Measures (ESM) as an issue of GATS is in hard negotiation. It is significant for promoting freedom of trade in service and protecting domestic industry. Negotiation on this issue has still stay on the discussions of desirable of ESM. Work party on GATS rules (WPGR) suggests that we could put both rules and desirable in negotiations. In the fact, there are many suggestions on rules, but have no agreement on some key questions. It even prevented further negotiation. There are also lots of dispute on some concrete definitions including "increase in imports" and "domestic industry". The thesis will analyze the value of ESM in standard of politics, economy and rule itself. And then, a possible rule system will be desire .In the end, there are some advices for stand and thinking of china in negotiation and legislation in the future.
