Research On Specific Safeguard Measures In Textiles

Specific Safeguard measures are among trade relieves of offered by World Trade Organization, which mean that a member can restrict imports of product if such product is being imported into its territory in such increased quantities which cause serious injury or great threat to the counterpart domestic industry.This paper gives a brief introduction to the general theories of WTO safeguard measures and Specific Safeguard measures in first part. Consequently, Specific safeguard measures are attached more and more importance by WTO members as a kind of powerful trade instrument, which contribute to relieve industrial injuries and equipoise trade interests. WTO Agreement on Safeguard establishes strict provision for implementing and procedural condition to guide the application for state members. In order to anatomize Specific Safeguard Measures on Textiles, we should give a textual research on the sources of Specific Safeguard Measures on Textiles at first. In the second part, this paper makes a critical comment on the WTO's legislative system of limiting liberty on textiles which involves six agreements, namely Avoidance of Market Disruption of GATT, Cotton Textiles Arrangements Regarding International Trade, Long-term Arrangement Regarding International Trade in Cotton Textiles, Arrangements Regarding International Trade in Textiles, Arrangements Regarding International Trade in Textiles and Apparel Products and Specific SafeIn the third part, this paper makes an example analysis on the trade dispute between Europe, the United States and China. Based on such analysis, this paper give some suggestion on countermeasures. In the last part, this paper makes a jurisprudence analysis on Specific Safeguard measures in Textiles and makes a critical comment on the China's legislative system.Economic globalization is the trend of economic development in the world today. Globalization should and must bring about new driving forces for economic development in all countries. China, as the largest developing country in the world will play an important role in this area. Upgrading the process of modernization on legal system of china and perfecting the Chinese safeguard system provide one example.
