For long time, the intellectual property right has been adhered to the strict region principle; as a result, the traditional conflict seldom happened. But gradually along with the development of international social and the economic , especially the value that intellectual property is the business enterprise immaterial assets has been greatly promoted, many protective international treaties about intellectual property appeared successively. The strict region principle was subjected to a narrow scope and the international protection of the intellectual property has been closely concerned by a lot of countries. Currently, the research about the intellectual property of international protective theories is not enough. Our legislation about the trademark of the international protection has been established, but there is still some place which is in out of line with the international treaties about intellectual property. In the legal practice, there also exist a lot of disputes about intellectual property commerce. It reflects the limitation in the protection of intellectual property by out country, out society and the business enterprise. It also counteracts the development of out business enterprise in the international world.This text tries to clarify the issue from two angles of view, one is the international intellectual property treaties, and the other one is the conflict law. Through the analysis of the two protective methods, and with our legislation and the legal practice of the protection of intellectual property, the author wants to give some constructive advice on the protection of our intellectual property with the hope that our business enterprise which has actively engaged in the international competition can develop swiftly and stably.
