Studies On The Law Of International Trade In Educational Services

Our country joined into WTO formally on December 11, 2001 and have made concrete promise in education service trade. Our education service trade legislation begins to enter world legal system. As several years have gone ,our international education service trade has made rapid progress under the frame of WTO/GATS.The influences of WTO/ GATS on education service trade gradually show up . Therefore , it will be very necessary for our legislation to reinforce the studying of education service trade under the fundamental frame of WTO/ GATS.This article begins from some basic problems such as the concept , the characteristic, the rationale and the historical evolution .Trough comparing and analysising other national correlation legislations as well as the GATS basic principle ,it proposes the legislation basic principle and the overall mentality as well as the legislation suggestion so as to reinforce fast development for the our country on international education service trade.In the foreword part, the article introduces topic background and purpose and has carried out brief commentary on scholar's research and current situation on home and abroad. At the same time ,it sets forth primal problem , method and train of thought about this article.The text is composed of 4 chapters. Chapter I is is the concept on international education service trade,including the concept, the characteristic, the rationale and the historical evolution.Chapter II is the legislation for international education service trade in homeland and region , including Australia ,Singapore and European Union. And it analysis and comments their characteristic in brief.Chapter III is the principle of GATS,including Most-favoured-nation treatment principle,National treatment principle, Transparency principle , Market access principle and the principle of the developing country participating in and exception.Chapter IV is the comparisin of both domestic and overseas. Through the interpretation of education service trade in the context of GATS and the analysis on the current situation and future development of education service trade , the paper proposes the reconstruction of the systematic framework for our domestic education service trade laws and the legislation.The last part is the conclusion of the whole paper.
