The Research On Identification Of Stealing Virtual Property From Network

With the rise and popularization of network and network game, the dispute about network games appears very often. Especially, there are more and more cases on virtual property theft from the network. How to correctly determine the legal nature of such acts has been a hot issue in theory research currently. By introducing the concept and characteristic of network virtual property, from the cases about disposal of infringing network virtual property in some countries and regions, and from the identification of stealing network virtual property in judicial practice in our country, this paper introduces the judicial condition of cases of stealing network virtual property. As an example of stealing network virtual property, analyzing the theory of crime composing, finding the difficulty of determining theft of network virtual property, this paper discusses the value evaluation of network virtual property, and whether network virtual property is real property, and the corresponding attributes of criminal law. We consider the finitude between the larceny and the dualism of criminal law, and we also hope to pay attention to the developments and changes of the theory of the Criminal Law in network space.
