The Research About Jural Coerce Sanction Of Administrative Cases In Supreme People's Court Communique

This paper analyzed jural coerce sanction of administrative cases in supreme people′s court communiquéin order to find the best pattern which not only exert the actual effect of cases in communiquébut also fit the concrete law circumstance of our country.The whole paper could be divided into four parts. The first part mainly defined the necessity of the research of jural coerce sanction of administrative cases in supreme people′s court communiqué. Based on the need of administrative judgement and the problem of the effect of communiquécase itself, it said the reason of this research. The second part is to demonstrate the best pattern of exerting the actual effect of cases in communiquéwhich is that cases in communiquécould attach to jurisdiction interpretation. The third one classified the relationship between the communiquécases and law through analysis of 63 administrative cases from 1985-2007. The last part summarized the regularization of communiquécases from the aspect of system and content.
