Research Report On Criminal Case Concerning Online Games

These years, with the rapid growth of online game industry, the issue of virtual property becomes more and more popular; in practice, it comes with many criminal cases and leads to an increasing number of legal disputes. This paper makes a start on discussion about the legal nature of"virtual property", then probe into a typical latest criminal case, after analyzing involved accusation, in the end, it reached a conclusion that the Criminal Law should be cautious when entering an uncertain new field. Finally, on the basis of analysis of concerned criminal theory, the paper makes legislation advice on computer crime in macroscopic, middle and microcosmic visual angle.This article which combines Intellectual property law and criminal law and crossed two disciplines different characteristics will research from the constitution of involved crime in the typical cases, and reach a conclusion that the criminal law have got into a dilemma. The author tried to use the knowledge of criminal law and intellectual property law, in-depth study of how to build and operate systemic legislation for the computer crime.
