| â… PurposeAs the most fundamental law in a nation, the constitution enshrines political system and basic rights of all citizens. Thus one of its most important characteristics is the stability. At the same time, this characteristic leads to an obviously conservative tendency, especially in a period of social transformation. On the one hand, all of the political restructuring must be executed within the institution; on the other hand, the previous constitution itself should be necessarily under reform. In a word, the constitutional reform is apparently vital in political reform. As for Taiwan's experience of the"constitutional reform", besides changes of the"constitutional system", the mode of its"constitutional reform"deserves further study.â…¡OpinionBased on the theories of constitution and politics, this essay is focused on the contents, functions, and reasons of the"constitutional reform mode". It is concluded that during the period of the"constitutional reform", when KMT (Kuo Ming Tang) was in power , a gradual process of"constitutional amending"was established, with the specific procedures containing out-institutional conference,"national assembly"operating, and so on. This"constitutional reform mode"is so important in Taiwan's"constitutional politics"that it performs functions as follows: stability, negotiations and topic settlements. But when DPP (Democracy Progress Party) is in its power, Taiwan's"constitutional reform"appears differently. DPP has declared that the boundary between the"constitution making"and"constitution amending"is not so valid now. To a certain extent, the effect of"constitution amending"is actually the same as"constitution making". This tendency is called"relativization". In Taiwan, the mode formation is determined by both domestic politics and external factors, such as the relationship of cross-strait and international elements.â…¢Basic structureThis dissertation consists of five chapters. The first chapter"Introduction"is mainly about the purposes, theories and concepts which are to be applied in the dissertation.Chapter two stared from the experience of some democratization countries. Through a point of historical view, the essay discusses the mode of Taiwan's"constitutional reform".Chapter three puts emphasis on political functions of the"constitutional reform mode".Chapter four makes an assay of reasons for the"constitutional reform mode"formation.Chapter five indicates complexity of Taiwan's"constitutional reform mode". |
