Legal Research On The Third Party Logistics Contract

TPL (the third party Logistics) is not only a mode of management, but an institution. It is implemented by a series of contracts, so it is an entrance to study the legal issues of the third party logistics.Firstly, the article clarifies the definition of the third party logistics, argues that the third party logistics contracts are a collection rather than a single contract, and are characterized by the three-bodied main contract and subordinate contract, the function of service and the relationship of the principle and the subordinate; and then analyzes the three forms of ordinary transporting, storing and agents in the mode of operation of the assets and agent-based logistics; thirdly, the article also discusses legal liability and legal application of the TPL contract in different operation modes according to the principle of international and marine multi-modal transporting attribution, and establishes incomplete liability, and uniform liability under the two modes. The article uses the combination of basic theories, practical cases, the law and regulations to discuss the legal application principle of the third-party logistics contract, and believes it is a best way to rely on the integration of statutes for TPL issue. Finally, the article argues that liability insurance is a guarantee for TPL.Additionally, the article argues that special arbitration centre is necessary for TPL legal issues and should be set up in order that some related legal issues may be solved professionally. TPL is an applicable subject and some difficult and influential cases are systematically summed up and then a theoretical conclusion is drawn, which may guide practice.
