A Study Of Jun Xun Yuan's Jurisdiction And Administration Functions

Jun Xun Yuan only existed during Tang ,Wu Dai Shi Guo and Song Dynasty in the feudal history of China .As so far , there is no special paper to make a study of Jun Xun Yuan in the academic circle.This paper plans to use an angle of view as legislation to have a rudimentary research about Jun Xun Yuan's jurisdiction and administration functions.The first section is the preface,introducing the subject background ,the study situation now in the academic circle and the innovatation of this paper.The second section is a summary of Jun Xun Yuan, dividing into three parts.Base of studying up history material,the paper draws the outline of Jun Xun Yuan's subordination during the three different historical period of Later Tang ,Wu Dai Shi Guo and Song Dynasty,and the main officials'official rank as well as its evolvation,such as Zuo You Jun Xun Shi , Zuo You Jun Xun Pan Guan.The third section is a study of the division of jurisdiction functions between Jun Xun Yuan and related institutions. Jun Xun Yuan only set up in Capital and spare Capital,so there're two types of related institutions which division of the jurisdiction functions with it .The first was the center institutions.The second was the local government which set up in Capital and spare Capital. Because in chinese feudal society, the local government got the judicial and administrative power together ,not separated. In all of the center institutions ,only Yu Shi Tai and Jiu Cha Zai Jing Xing Yu Si which existed a short period in Bei Song, was to be direct division of judicial power with Jun Xun Yuan.Yu Shi Tai ever overtook the judicial power belonged to the local government,and to perform the powers in some administration field neck and neck. The officals'appointment of Jun Xun Yuan has a profound original relationship with Yu Shi Tai,too. There are different percentages about the jurisdiction functions between Jun Xun Yuan and the local government of Capital and spare Capital during Later Tang ,Wu Dai Shi Guo and Song Dynasty. The percentages of Jun Xun Yuan is small in Later Tang,to be large in Wu Dai Shi Guo,and in Song Dynasty the most obvious characteristic is the jurisdiction functions.The fourth section discusses Jun Xun Yuan's jurisdiction functions. Jun Xun Yuan's jurisdiction functions in Later Tang include arrest and prison management.In Wu Dai Shi Guo,the functions include national security,investigation,judgement and prison management,including arrest,investigation and prison management in Song Dynasty.The fifth section discusses Jun Xun Yuan's administration functions. We can not find any history material about Jun Xun Yuan's administration functions in Later Tang. Jun Xun Yuan elaborate the administration functions to the tiptop in Wu Dai Shi Guo, including safeguard of capital order ,taxation,business and land. The functions is to decline sharply in Song Dynasty,only about the management of imperial government's manners, guard of the imperial government and fire control.The sixth section tells about two items of judiciary systems which relate to Jun Xun Yuan in Song Dynasty,such as Ju Yan Fen Si system and Fan Yi Bie Kan system. Jun Xun Yuan was the main carrier of carrying out the two systems,and resolut Jun Xun Yuan only has the powers of investigation ,no judgement functions at that time.The seventh section gives a closing remark.This part is to summarize the full thesis,and to point out the two trends of Jun Xun Yuan development process during Later Tang ,Wu Dai Shi Guo and Song Dynasty.
