A Study On Social Vulnerable Groups' Rights Protection From People-oriented Angle

During the system conversion period in China, the rapid transformation of social structure leads to the intensification of social stratification, and social vulnerable groups in the society begin to appear from hidden condition. The study on social vulnerable groups originated in sociology. Scholars have conducted extensive researches on social vulnerable groups, such as the concept, the characteristic, the composition and the classification etc. And it has drawn much attention in the scope of law science as it has become more obvious. From legal perspective,the lack of rights is the major cause of the formation of social vulnerable groups. Rights protection is the effective protection manner for social vulnerable groups. Only if the problems of social vulnerable groups are brought into the view of law, social vulnerable groups can obtain permanent and effective protection. People-oriented is the inheritance and development of Maxis humanism and is the further development of traditional people-based thought in China and humanistic thought in the west. The development history of human oriented is the history of concern and protection to social vulnerable groups. As the core of the scientific development, people-oriented matches the protection to social vulnerable groups. People-oriented can provide theoretical support for protecting the right of vulnerable groups with its philosophical connotation and moral implication. People-oriented is the major value of the protection of the vulnerable group in the society and provides the theoretical base for the protection of social vulnerable groups. Under the guidance of people-oriented, social vulnerable groups'rights should be the basic value for rights and power, rights and duty; fairness should be the basic value for efficiency and fairness; justice should be the basic value for formal equality and substantive equality. From the perspective of people-oriented, we should do the followings in order to promote the system construction of the rights protection to social vulnerable groups:firstly,we should choose existence oriented to perfect the supportability of legal system;secondly,we should choose development oriented to perfect the development of legal system.
