Studies On Cybercrime

Along with the deep application of computer network in the various social domains, the cybercrime day by day becomes one of the crimes which severely impair the social order, and receives the attention in various social aspects. On the foundation of absorbing the experts'research achievements, the article tracks the latest tendency of cybercrime, attempts to carry on the research of some dispute questions in the field of cybercrime in a new angle of view. The article is composed of five parts besides the introduction and the conclusion:Part one: Introducing the present situation of cybercrime legislation of foreign and our country. It plays a foreshadowing role to the fifth part.Part two: The conception of the cybercrime. Beginning with analyzing the cybercrime concept's origin, this part introduces the evolution progress of the concept from the computer-related crime to the cybercrime. It redefines the cybercrime by analyzing the essential characteristic of the cybercrime. It also construe the relationship between the computer-related crime and the cybercrime.Part three: Analyzing the constitution of the cybercrime. After analyzing the constitution of cybercrime, the part discusses the object ,the objective aspects,the subject and the subjective aspects.Part four: Defects and perfection of the cybercrime legislation. This part which is the most important part of the article focus on giving the consummations in four aspects :the General and the Sub of Crime constitution, criminal evidence, Judicial assistance and extradition system.
