Cyber ​​crime And Its Punishment Regulatory System

Information technology, computer, network technology and so on have brought the huge crime space as well as impelled society progress. The cybercrime not only bring the huge economic loss to the victim, but also disturb society's economic order and threaten the national security. Therefore, we must pay enough attention to the cybercrime to guarantee the normal development of the network order. This article summarizes the domestic and foreign research results and proposes some of my own opinions and viewpoint.The paper is composed of four parts. The first part introduces the present situation and the tendency of the interrelated cybercrime to enable everybody to have a preliminary understanding to the present cybercrime. So that it can arouse the people's attention to the interrelated cybercrime. It also prognosticates the development tendency of the interrelated cybercrime from the macroscopic aspect.Beginning with analyzing the cybercrime concept's origin, the second part introduces the evolution progress of the concept from the computer-related crime to the cybercrime. It redefines the cybercrime by analyzing the essential characteristic of the cybercrime. It also construe the relation between the computer-related crime and the cybercrime.The third part analyzes the constitution of cybercrime, and discusses the subject, the subjective aspects, the object and the objective aspects.The fourth part introduces the present situation of cybercrime legislation of America, England, Germany, France, Russia, Japan, Korea and our country, analyzing and comparing each country's cybercrime legislation model. It also proposes some preliminary ideas to perfect our country's cybercrime legislation.
