| Emission trading is a current economic policy which draws various countries' attentions. It was first put forward by American economist Dales. As one economic policy based on the market, it can coordinate the relation between the economic development and the environmental protection, therefore to realize the society's sustainable development.Our country put emission trading into practice in partial provinces from the end of the 80's. Along with the experiments, the problem that legal mechanism of the emission trading lags behind the practical needs became obvious. Thus using legislation theory, real diagnosis analysis method and so on, this article tries to conduct a research on the present situation, the legal mechanism of emission trading and the content it should cover.The first part states the research goal, the significance of emission trading as well as the domestic and foreign research situation in present; The second part elaborated the meaning of emission trading, its economic theory basis, the superiority and the relevant legal mechanism overseas; The third part in detail provided the necessity and the feasibility of emission trading in our country; The fourth part based on the former three chapters proposed perfect legislation conception of emission trading in China.
