Since working is the significant way human beings creat both materialand spiritual wealth and also the fundamental rights with which theConstitution endows every single citizen, forbiddance of discriminationin employment is part of the human rights protected by home laws andinternational conventions. When the working opportunity of some peopleis bereft or their working value inadequately acknowledged, these peopleare not treated equally and their rights are not respected. Due to theirphysiological limitation, the disabled is different from normal peoplein working abilities. The limitation of their occupation scope makesactually impossible the disabled being treated equally with normal peoplein employment.In the eyes of human rights, the disabled have the common and equal"citizenship", the society is responsible for protecting their rights,and the disabled carries out a citizen's obligations as well. In orderto be acquainted with the current situation of the equality rights inemployment of the disabled, the author spent four months taking a survey.According to the survey, in general, the disabled are not well educatedand the employment rates, working classes, incomes and the career satisfaction degree of the disabled are low. The discrimination againstthe disabled in employment and other aspects should not be neglected.On the basis of survey, this paper is divided into four parts. Part Oneis the introduction, in which the author fixes on the object of researchthrough analyzing the definition of the disabled and discrimination andsummarizes the materials in existence on the employment of the disabledand then presents the survey made by the author. In Part Two, the authoranalyzes both the home laws and the international conventions concerningthe anti-discrimination in employment of the disabled, and the measuresadopted by different countries. The author concentrated in the introducetion of international anti-discrimination conventions and the analysisof the laws and statutes of China in respect of the rights of the disabledin employment. Part Three is the important part of this paper, and theauthor spent most time on it. In this part, the author analyzes theemployment rates, education, position of employment, the discriminationagainst different classes of deformity and the awareness as well as theredressness of discrimination, and the author also has several calls ondisabled individuals. In Part Four, the author analyzes the laws and thesystems with regard to the employment of the disabled and then offersmeasures.In contact with the disabled, the author gets the point in mind thatthe society should not allow any kinds of discrimination against thedisabled, and competing equally never conflicts with reasonable favor.
