Discussion On The Compulsory Land Acquisition System

Article ten of the Constitution of the P.R.C entitles the State to acquire land by compulsory purchase for public interest by providing compensation for owner or user of the land. The same article appears in article two of the Land Administration Law. The Constitution and the Land Administration Law are the main law for compulsory land acquisition (CLA). Though being lots of other legal documents,the CLA system is still far from perfect.I try to expound systematically and roundly the CLA system from the five parts below:Part one gives the definition,the theory source and the history of CLA,which is the base of the following text.Part two discusses the purpose of CLA by studying the interest balance between CLA conduct and CLA system and introducing the corresponding provisions of other countries and then gives my proposals.Part three discusses the procedure of CLA by starting from the concept and legal meaning of procedure,indicating the importance of procedure within the whole CLA system,introducing the corresponding provisions of other countries and then gives my proposals.Part four discusses the extension,standard and forms of compensation first and then gives my proposals. Solutions for compensation dispute come the last.Part five mainly discusses the legislation mode and basic principles of CLA system of China.
