Study On Transportation Crime

The transport crime which is stipulated in Chinese and foreign criminal law, is a kind of crime classified by behavior. But the theoretical circle has little study about it, which causes the theory and practice becoming apart. This article analyzed the concept, the crime constitution characteristic, the transport crime special aspect and so on which can made it a complete system.The article studied from the definition of transportation crime frist,and analyzed the definition about the crime. And proposed the "illegal ownership" as the standard to define the definition. The article noted the characteristics of the crime and gave it a suitable categories.In the chapter of the transport crime constitutes, the article emphatically has discussed the hard problem which belonged to the transport crime subjective aspect and the objective aspect and made the simple introduction to the transport crime object and the main body. And summarized the meanings of the behavior in criminal law.Has mainly analyzed transport questions about the crime number shape, stop shape, accomplice shape in the transport crime special shape. Mainly analyzed how to determine guilt in four kinds of situations. The article think transportation crime is a rapid crime and analyzed the patterns of crimeHas made a brief analysis about the legislation flaw and the consummation about the transport crime in our country. Proposed the flaw with our law and stated the way to improve it.
