International financial leasing is the offspring of financial leasing internationalization. Financial leasing has showed flourishing vitalite once it came into being. Financial leasing has made an important contribution since it was introduced into in 1980s.However, because it has a latestart in China, its making of law and some related mating institutions are not perfect now. So the development of financial leasing is restricted badly. This article deeply analyzes the meaning and substantive characteristics of financial leasing, minutely explains all parties' assignment of rights and liabilities and the channel of treaty violation. In addition, the article's keystone is introducing the phenomenon of sub-leasing and shipping financial leasing. So, through the analyse of financial leasing and the introduce of develop experience of overseas financial leasing, then contrast to the financial leasing's current situation in China ,the author probes into issues of the making of law on financial leasing in China and put forward his suggestion in making of law, integrating the fact.International Financial Leasing is the product of the international leasing. It has showed its vigorous vitality since it came into being. Since the introduction of lease financing of China in the 1980s of the 20th century, the contribution in building of China's economic should not be overlooked. However, due to the financial leasing in our country started a little late, the legislature and the relevant supporting system is not perfect, resulting in the development of leasing business have large constraints.This paper analysises the intention and essential characteristics of lease financing in a deep going way, and it also describes the responsibilities of the leasing parties and the distribution channels for relieving default in detail, and highlights the switch leasing of financing leasing, and the ship back to the ancestral lease financing phenomenon. Through the analysis of lease financing ,the introduction of the development of leasing financing in foreign countries and the comparison of the current situation of China's financial leasing, the author discussed the current problems existing in related legislation of China and proposed his own legislative proposals combining the reality.In the process of writing this paper, the author uses the theoretical analysis, empirical analysis, comparative analysis, historical analysis and other research methods integratedly. The main text is divided into three parts:Section 1:General introduction of international financial leasing (Chapter 1-Chapter 2).It introduces the development of the lease financing and the mutual relation between lease financing and leasing. According to the Legislative and academics theory, define the lease financing from concept and sum up the basic legal characteristics of financing and leasing. On this basis, find out the distinction between the financing lease parties to the rights, obligations distribution in detail.Section 2:Special leasing system of financial leasing(Chapter 3).After we have general understanding of financing lease, in this part ,the author focuses on analyzing the more special sublease, and leaseback financing and ship leasing system financial leasing practice.Section 3:Leasing development experience and legislative proposals (Chapter 4-Chapter 5).On the basis of summing up the advanced experiences of overseas development of the financial leasing and inadequate of China's related fields, the writer gives his proposal on China's financial leasing legislation. This is the focus , study purpose and destination of this paper.
