The Regulating Function Of Law On The Development Of Science And Technology

The level of development of modern science and technology has already become a sign of national strength. Therefore, the governments of many countries all pay great attention to improve their respectively rules of law to regulate the development of science and technology. This results from the development of both science and technology and law. How to solve the complication problem caused by the regulating function of law so as to enhance current jurisprudence and establish new laws? How to strengthen the legal system so as to guarantee and promote the development of science and technology? The above-mentioned questions are of great practical value and they deserve an in-depth study and an appropriate solution.This dissertation firstly introduces the impact of law on the development of science and technology. Meanwhile, this dissertation emphasizes that the regulating function of law on the development of science and technology, which is the core among the impact of law on the development of science and technology, reflects the fundamental functions of law.Secondly, this dissertation summarizes the pro-and-con influence of the development of science and technology, analyzes the cause of this influence and emphasizes the importance of mastering the value orientation of the development of science and technology. On this basis, the regulating function of law is the effective measure to master the social construction of the development of science and technology.Thirdly, this dissertation elaborates on the complication problem caused by the regulating function of law and summarizes this problem in terms of channels and results of the regulating function. And this dissertation analyzes the cause of the complication problem.Then, this dissertation tentatively brings forward the fundamental and special principles to resolve the complication problem caused by the regulating function of law on the development of science and technology.Finally, this dissertation thinks over the current situation and the present problems of scientific and technological law system in China and puts forward several legal countermeasures, which provides a comprehensive and solid legal guarantee for constructing scientific and technological law system in China.
