Since the promulgation and implementation of (the people's republic of China Science and Technology Law)(hereinafter referred to as the (Science and Technology Law)), this law has become an important gist for the implementation of the stratagem of using science and technology to prosper country. Propelling science and technology advancement by law provides strong lawful guarantee for the whole science and technology advancement. Remarkable effect has been achieved in science and technology advance. During the implementation of the (Science and Technology Law), however, with the development of economy and society, incessant science and technology advancement and its development course exposed the (Science and Technology Law) some objections existing in some system design and arrangement. In order to suit the requirement of historical development, especially the requirement to china current social and economic development as well as science and technology advancement, the emendation and improvement for the(Science and Technology Law) is placed on schedule. National People's Congress has listed the emendation and improvement for the (Science and Technology Law) as legislation plan.Nowadays, the theoretical circle hasn't made complete, systematical evaluation and research on the improvement way of the (Science and Technology Law). This article, from the point of practice of science and technology work, by the way of comparable, systematic and demonstrative research, according to the international and domestic economic and social development and current situation and tendency ofscience and technology advancement, try to analyze and criticize the function and fault of the (Science and Technology Law). Under the premise of the further understanding the whole science and technology development course, this article put forward the practical suggestions on further improvement for the system design and arrangement of the (Science and Technology Law) and is of realty and reference.This article consists of five parts. The legislation background, main content with its active function of the (Science and Technology Law) is introduced in the first and second parts. In the third part, the science and technology policy trend in major countries of the world, with legislation trend has been analyzed. In the forth part, the major problems during the implementation of the (Science and Technology Law) have been analyzed. The fifth part, under the base of the previous-mentioned parts, suggestions have been put forward for the improvement of the (Science and Technology).
