The Consideration Of Perfecting China's Civil Air Defence Law System

Every country must have defence.As the great constituent of country defence,the civil air defence law system is of great impotrance to construction of the country defence. A coordinated and complete civil air defence law system is the precondition and basis of building civil air defence by law. Researching and perfecting the civil air defence law system bears on perfecting the whole social law system with Chinese characteristics.This thesis first tells the definition and characteristicsof the civil air defence law system,and compares international civil air defence law system ,in order to facilitate the perfection of the civil air defence law system in China.Second,it summarizes the current situation of the civil air defence law,relates the consistent of the civil air defence law,and pinpoints the existing problems as follows: 1)unreasonable and unperfect structure;2)defection in content;3)disconcert with other law systems; 4)crude legislation methods.Analysis has been made on the reasons for these problems the following aspects: 1) lack of law awareness; 2)inadequate awareness of civil air defence by law;3)inadequate importance to law legislation because of leadship system;4)undemocratication in civil air defence law legislation.In the final part,the thesis puts forward fundamental principles in the construction of the civil air defence law system and raises the five key issues to be improved: 1)legislation planning;2) practical operation;3)procedure;4) coordination.The following four principals shall be observed:1)gear to international practice;2)gear to society and economy growth;3)gear to city building;4)keep in tune with other law systems.It also comes up with considerations concerning the construction of China's civil air defence law system from the perspectives of:1)changing concepts;2)reforming legislation system;3)perfecting the structure of the civil air defence law system;4)strengthening democratic legislation;5)improving legislation methods.
