The Research Of Constitution Law On The Protection Of The Rights Of Migrant Rural Workers

Since the eighties of last century,with the nation's reform and open going in depth,industrialization and urban construction going faster,a great number of surplus labor forces from the countryside has gone to work in the cities.Their status of registered residence is peasant,but they engage in non-farm work which is the major source of income for life.Thus a special group in our society has come into being---the city migrant rural workers.According to statistics,there are 200 million migrant rural workers in China now and the number tends to increase.Migrant rural workers have grown into the main body of the industrial workers.The presence of migrant rural workers has solved not only the problem of increasing the workers' income but also the severe problem of employment of the surplus labor forces in the countryside,and given impetus to the adjustment of industrial structure and the increase of national economy,and at the same time,promoted the modernization of the migrant rural workers and the countryside.Migrant rural workers have pushed forward the development of national economy and social advance with their hard work in all trades and professions.They have made great contributions to the building of socialist modernizations.However,ever since its early years,this large social group has been in a state of "the imperfection rights" and "the deprivation of rights".Migrant rural workers are sufferring various restrictions and discriminations on employment.And they can not own equal employment right.And they can not enjoy equal pay for equal work irrespective of urban residents,and their wages paid to them is usually deducted or delayed without justification.There are poor working enviromnent and lack of unprotected work and social security.Once a time, various phenomena of damaging interests of farmer workers are terribly serious.This not only damages interests of migrant rural workers,and also causes a series of serious social problems.Though our government has strengthened protection of the rights and interests of migrant rural workers in recent years,and made some policies and taken some measures,there are a lot of problems in Constitution protection for the rights of migrant rural workers.People have to worry the actuality of the Constitution rights of migrant rural workers.While China's socialist modernizing construction and building a well-off society in an all-round way has gone into new stage,the problems,such as how to protect constitutional rights of migrant rural workers,to realize society equality and build a harmonious society,has to be solved in the society of rule of law.This paper,on the basis of analyzing causes of origin of migrant rural workers,has shown clearly that migrant rural workers should enjoy the Constitution rights and the existing condition of Constitution protective rights.And it has put forward outlets and suggestions for solving migrant rural workers' rights,and claimed that social security system for migrant rural workers should be improved and public management mode for migrant rural workers should be created on the basis of completely reforming residence management system.The paper has also claimed that with implementing of quickening system innovation and protecting equal employment right,educated right and right of action of migrant rural workers, it has solved the basic survival life problems faced by migrant rural workers. They have obtained the effective judicature relief when their rights are being damaged.
