Geographical indications is a important kind of the intellectual property. One such provision in The Agreement on Trade Related Aspects of Intellectual Property Rights ("TRIPS") call for the protection of geographic indication for goods, and TRIPS protects geographical indications as a kind of intellectual properties. More and more countries realize the importance of the protection of geographical indications and take all kinds of measures to protect it. European Union (EU) has legislated the regulation on protection on geographical indications and brings immense effect.China boasts a boundless expanse of territory and numerous traditional productions with local characteristic that are competitive in the international market. It is of great importance to protect the geographical indications of these fine and special productions in China. The history of protection on the geographical indications and there is no systemic institution in China. Now China has two mode to protect geographical indications: the protection by the Trademark Law and protection by the Regulation On the geographical indications good. Two different administrations operate the Protection by different laws. The two system not only conflict with each other, but also waste a lot of money, etc. It is unfavorable to the protection of geographical indications..By the research of EU regulation of protection on geographical indications and drawing on the experience of EU, the paper suggests China set up the special law on base of the protective regulation of products in geographical indications. Lastly, the paper put forward the draft of protective law of products in geographical indications.
