| European nations have formed local characteristics in the process of agricultural planting and production for a long time, especially in food and agricultural products. The good production mechanism promotes the development of the local or even national economy. This is benefited from EU geographical indications protection system. In fact, the EU geographical indications protection system is not so complete and mature at the beginning. Since the European Community established, EU has issued a large number of regulations in order to narrow the gap between countries by lawmaking. The constant changing of special law greatly promotes the development of geographical indications protection system in EU and the world.Although the geographical indications protection system in China develops fast in this century, but some problems still exist as it is at a late start, lacking experience, and bad local adaptation, etc. 2015 is the starting year of managing state affairs according to law in China. To take this opportunity, we should actively use the experience in EU geographical indications protection system for reference.This paper firstly introduces relevant conceptions, including indications of source, appellation of origin and geographical indications. Then, it introduces the international endeavor in the construction of geographical indications, presenting the background and content of Paris Convention, Madrid Agreement, Lisbon Agreement and TRIPS Agreement. Thereafter, the paper comes into the key chapter, introducing the relevant definitions, background, application and other items in important regulations of agricultural products and food, grape wine and spirits, and gives the comprehensive analysis. After that, this paper states the general development history and the content of geographical indications protection system in China and some problems. Finally, it discusses how the system in China draws lesson from the EU geographical indication protection system in application. |
