Legal Research On International Regulation Of Financial Holding Company

With the trend of financial globalization and liberalism, multi-operation is replacing divided-operation day by day. Financial company, is regarded the best pattern among all patterns of multi-operation ,and is also the most suitable pattern for China's financial reform. With proper designation and structure, financial holding company gathered funds, achieved scale economy , disperse risks of a single financial company, and enhance the stability of financial conglomerates. It has greater potent- ion and more ability for competition in this competitive world.Just as every coin has two sides, financial holding company has caused a lot of negative effect as well as the advantages it brought us . To avoid harm done to us arisen from those negative effects, supervise the healthy development of financial holding company, this article proposes some suggestions , after investigation of our motherland's reality and the development trend of finance in the world.This thesis contains four parts. In the first part it describes the concept of "financial holding company" with introduction to "holding company" beforehand. Then it analyses the inevitable trend of financial holding company's appearing and development, introduced it's advantages and shortcomings. The second part introduced the supervision experience of financial holding company of three developed countries: America , Great Britain and Japan. They could bring us some valuable inspiration for our own country's supervision system. The third part is about two international documents on supervision of financial holding company. Basel New Capital Agreement and the final document from the Joint Forum Financial Conglomerates. They are two most important results in the world concerning research of supervision of financial holding company. The last chapter illustrates China's own development of financial holding company and its special reality, legal supervision circumstances, present legislation and gives the author's own suggestion for improvement of supervision of financial holding company in China , also included some measures should be taken to cooperate with other nations around the globe.
