| Chapter One had briefly reviewed countervailing duty cases between Canada and China, and between U.S.A. and China. Then this chapter introduced subsidy system of WTO. Agreement on Subsidies and Countervailing Measures and relevant clauses of other protocols formed subsidies and countervailing measures system under WTO legal system. Follow the regulation of SCM, this paper would mainly study on legal issues of actionable subsidies.Chapter Two adopted the standards of SCM, and judged actionable subsidies from three factors: cumulation, adverse effect, and causal relationship. In order to do some empirical study on the application of WTO member's countervailing measures, this chapter quoted judgments from U.S. International Trade Commission.Chapter Three studied on Current situation of China's actionable subsidies, and analyzed subsidies which U.S.A. appealed to WTO. This chapter pointed out disadvantages that China would face when cope with countervailing measures.Chapter Four put forward some suggestions to improve China's actionable subsidies system. Firstly, we should adjust existing actionable subsidies, and learn how to make use of WTO rules. Secondly, we should take measures to establish a mechanism to deal with countervailing measures. |
