Constitutional Protection About Private Ownership Of Property

In the modern constitutional country, ownership of property, civil's life rights and free rights compose of the basic rights of people, and they embody people's value and dignity. As a country's basic law and the maximal value system of community of society, constitution always takes the protection ownership of property as the basis of the society. As one of the constitutional foundation stone, ownership of property is not only reflecting the government's ability , but also refracting one country's constitutional developing level. Therefore, studying deeply into the value of private ownership of property of constitution , has important historical and practical significance.This thesis is composed of three parts together, Part I has studied fundamental private ownership of property theory , then we sum up the inherent evolution logic and developing law of private ownership of property. Part II we begins with analysing the constitutional theory and practice western countries takes. Then finally, we change our centre into studying our country. Through analysing the ideal and real situation of our country's constitutional protection of private ownership of property , reveal that our country should not only protect the static ownership of property constitution system, ought to bring the constitutional protection of private ownership of property into a development working orbit, reinforce the construction of constitution explanation system, constitution supervision system etc. Only do it like that, we can really complete the historic mission of constitution protecting citizen's fundamental rights.
